1. Acceptance and Scope
By using this website, you agree to these terms. If you do not agree, please do not use the website. Submitting an enquiry or booking request does not create a photography contract. After reviewing the request, Boudoir Studio sends an invoice. A booking becomes binding only after Boudoir Studio has received the 50% down payment and the Client has received Boudoir Studio’s booking-confirmation email. Until both steps have occurred, the requested date is not confirmed.
“Boudoir Studio” means the photography service operated by Kurt François in Albion, Mauritius. “Client” means the person making the booking and, where applicable, the people participating in the session.
2. Website Information
The website provides general information about services, examples of photographic style, indicative pricing and availability. Reasonable efforts are made to keep it accurate, but website content may be corrected or updated without notice. A personalised quotation or written booking confirmation takes precedence over general website information for that booking.
Portfolio images illustrate style and approach; they do not guarantee an identical result because people, locations, lighting, weather and creative decisions differ between sessions.
3. Bookings and Eligibility
The person making a booking must be at least 18 and have authority to agree on behalf of any group participants. Intimate, boudoir, semi-nude, nude and intimate-video services are strictly for adults aged 18 or over. Proof of age may be requested.
A minor may participate only in an appropriate non-intimate service with the knowledge, permission and involvement of a parent or legal guardian.
The Client must provide accurate contact, scheduling and session information and disclose practical matters that could materially affect safe delivery of the service. Boudoir Studio may decline a request that is unlawful, unsafe, outside the offered services or inconsistent with professional boundaries.
4. Prices, Down Payment and Payment
Prices are stated in Mauritian rupees unless indicated otherwise. After receiving and reviewing a booking request, Boudoir Studio sends the Client an invoice showing the selected package, extras, travel or printing charges where applicable, the 50% down payment, remaining balance and payment dates.
The requested date becomes a firm booking only when Boudoir Studio has received the 50% down payment and the Client has received the booking-confirmation email. Payment of the invoice without that confirmation email does not by itself confirm the date; the Client should contact Boudoir Studio if the email has not arrived. Unless the confirmation says otherwise, the outstanding balance must be paid no later than the agreed delivery or collection stage. Final files, prints or products may be withheld until cleared payment is received.
Valid coupon codes apply only according to their stated value, expiry and conditions. They cannot be exchanged for cash, combined unless expressly permitted or retrospectively applied to a completed booking.
5. Cancellations, Rescheduling and Lateness
If you need to cancel or reschedule, contact Boudoir Studio as soon as possible. A Client cancellation does not normally make the 50% down payment refundable. Where reasonable notice is given, Boudoir Studio will try to move the booking to an available alternative date, subject to the specific confirmation terms.
Failure to attend without notice may result in forfeiture of payments already made. Arriving late may reduce the available photography time where another commitment prevents the session from being extended.
If Boudoir Studio must cancel and cannot offer a suitable alternative, amounts paid for the unavailable service will be refunded. This is without prejudice to any mandatory rights under applicable law.
6. Weather- and Condition-Dependent Sessions
Portraits under the stars, Milky Way photographs and other location work depend on weather, visibility, moonlight, access and safety. A particular astronomical feature or sky condition cannot be guaranteed. Boudoir Studio may adjust the time, location, approach or date where conditions are unsuitable.
The Client must follow reasonable clothing, footwear, transport and safety guidance for night or location sessions. If safe production is not possible, Boudoir Studio may pause or end the work and discuss an appropriate alternative.
7. Conduct, Consent and Safety During a Session
All participants must behave respectfully and follow reasonable studio and equipment-safety instructions. Boudoir Studio may stop a session where conduct is abusive, unlawful, unsafe or materially disruptive.
For intimate work, consent is ongoing. A participant may pause, add clothing, decline a pose or stop the session. Ending or narrowing a session for personal comfort does not automatically create a refund where Boudoir Studio remained ready to provide the booked time and service.
One support person may attend where agreed beforehand. Guests must respect the Client’s privacy, professional boundaries and the working environment. Children are not permitted at intimate sessions.
8. Creative Approach, Selection and Editing
By booking, the Client acknowledges Boudoir Studio’s photographic style and gives reasonable creative discretion over lighting, posing guidance, composition, equipment, selection and editing, within the agreed concept and boundaries.
The number of delivered images, selection method, included edits, format, resolution and expected delivery period are determined by the package or written confirmation. Unselected proofs, duplicate frames, test images, rejected files and editable working files are not normally delivered.
Reasonable correction requests may be considered if made promptly after delivery. Extensive compositing, body alteration or a new editing style is outside the original service unless separately agreed and priced.
9. Delivery, Downloads and File Storage
Digital files may be supplied through a private online service or another agreed method. The Client is responsible for downloading the files before any stated expiry and maintaining personal backups after delivery.
Boudoir Studio takes reasonable care of working and delivered files but does not promise indefinite archival storage. Any archive or re-delivery request is subject to the files remaining available and may involve an administration charge.
10. Privacy, Publication and Image Rights
Client images are not published by Boudoir Studio without separate written permission. Declining portfolio or promotional use does not affect the standard of a paid private session. Further details appear in the Website Privacy Policy and Safety, Privacy & Confidentiality information.
Ownership, licences and permitted use of commissioned photographs follow the written booking or session agreement. Where ownership transfers to the Client after full payment, that transfer does not give Boudoir Studio permission to publish private material; publication still requires the agreed consent.
The Client is responsible for obtaining permission from other participants before distributing images in a way that affects them. Images must not be used unlawfully, deceptively or to harass, defame or exploit another person.
11. Prints, Albums and Other Products
Printed products may vary slightly from screen previews because of materials, paper, canvas, inks, display calibration and production tolerances. The Client must review names, dimensions, crops and other approval details before a customised product is ordered.
Because personalised products are made for a particular Client, cancellation or return rights may be limited once production has started, except where a product is defective or mandatory law provides otherwise. Visible damage, manufacturing faults or order errors should be reported promptly with supporting photographs.
12. Website Content and Acceptable Use
Unless otherwise stated, the website design, writing, graphics, logos and displayed portfolio material are protected by intellectual-property rights. You may browse and share links for personal, non-commercial purposes. You may not copy, scrape, republish, sell, remove attribution from or create derivative commercial material without permission or another lawful basis.
You must not attempt to interfere with the website, forms, server, security controls or another visitor’s use of the service.
13. Third-Party Services and Links
The website may link to Google Maps, YouTube, social media, publications or other external services. Those services operate under their own terms and privacy practices. A link does not amount to control of or responsibility for an external website.
14. Responsibility and Liability
Boudoir Studio will provide services with reasonable care and skill. Nothing in these terms excludes or restricts liability that cannot lawfully be excluded, including applicable statutory consumer rights.
To the extent permitted by law, Boudoir Studio is not responsible for indirect or unforeseeable loss, loss caused by inaccurate Client information, failure to follow reasonable instructions, third-party platforms, events outside reasonable control or the Client’s failure to download and back up delivered files.
If equipment failure, file corruption, serious illness or another exceptional event prevents substantial delivery, the appropriate remedy may include re-performance, replacement, credit or refund for the affected part, depending on the circumstances and applicable law.
15. Events Outside Reasonable Control
Neither party is responsible for delay or failure caused by events reasonably beyond its control, including severe weather, natural disaster, government restriction, widespread service outage, venue closure or sudden serious illness. The parties should communicate promptly and try to agree a fair rescheduling or alternative arrangement.
16. Changes and Severability
These terms may be updated for future website use or bookings. The version accepted or supplied with a confirmed booking continues to govern that booking unless both parties agree otherwise or a legal requirement applies.
If a provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision immediately is not a waiver of that provision.
17. Governing Law, Questions and Disputes
These terms are governed by the laws of the Republic of Mauritius. The parties should first try to resolve a concern directly and in good faith. Nothing in this clause prevents a Client from using any complaint, consumer-protection or court process available under applicable law.
